TFC Hosts the 2025 UGC Committee

This spring the Texas Uniform General Conditions (UGC) Committee completed its review of current contract requirements for State construction and provided recommendations for the 2025 update. Once adopted in their final form, the 2025 UGCs will become the standard for State construction projects for the next five years.

The State of Texas Uniform General Conditions, per Texas Government Code Ch. 2166, prescribes the specifications that must be included in all State construction contracts. The Texas Facility Commission (TFC) administers the UGC, and every five years the agency convenes an advisory committee to review and provide recommendations for any necessary revisions. The committee is comprised of public and private, design and construction industry representatives. The COVID-19 pandemic prevented the committee from convening in 2020, therefore the 2015 UGC is the current version under revision.

The 2025 committee engaged in several meetings to identify a list of proposed revisions and understand the different perspectives of the organizations engaged in the construction of State projects. Smaller, break-out groups delved deeper into each item to refine the list. The March in-person session included final reviews and adjustments to establish the committee’s list of recommended revisions.

TFC and the State of Texas will use the committee’s recommendations to determine which revisions are in the public’s best interest. After review by the Texas Office of the Attorney General, the revisions will be adopted at a Texas Facility Commissioner’s meeting.

The 2025 UGC revision recommendations include:

  • Updated references based on new legislation, including State and federal Buy America provisions.
  • Increased flexibility requirements for projects that have different complexity and size.
  • Increased provisions for construction manager-at-risk delivery.
  • Ensuring prompt payments for work completed.
  • Minor wording changes to increase clarity and understanding.
